They say a picture is worth a thousand words, but a properly rights-managed creative work could be worth thousands of dollars… or more! As authors, we tend to focus on the immediate paycheck from editors or publishers, but beneath the surface, there are layers upon layers of value to consider. Protecting your intellectual property from the outset can significantly enhance your creative and financial legacy. Let's walk through how to secure and optimize your creative rights step-by-step.

Step 1: Understand Automatic Copyright

Good news! Your work is automatically copyrighted the moment you put pen to paper (or fingers to keyboard). Copyright means you have exclusive legal rights to reproduce, distribute, perform, display, and create derivative works from your creation. Generally, copyright lasts for the author's lifetime plus 70 years after their death, ensuring your heirs can benefit from your creative efforts long after you're gone.

Step 2: Register Your Copyright

Though automatic copyright is helpful, officially registering your copyright with the Library of Congress provides extra protection and proof of your ownership.

  • How to Register: Visit Copyright.gov to complete an online application.

  • Cost: Generally around $45 per submission.

  • Benefit: Provides legal evidence of your ownership in case of disputes.

Step 3: Know Your Additional Rights

Understanding the breadth of your ownership empowers you to maximize your creative work's value.

  • Audio Rights: These give you control over audiobook and podcast adaptations of your work. You can sell or license these rights separately.

  • Film and TV Rights: Your stories could become films or television shows. Hold these rights carefully, as they can be highly lucrative.

  • Translation Rights: Control who translates and publishes your work internationally.

  • Merchandise Rights: If your work can inspire merchandise (t-shirts, mugs, art prints), these rights ensure you earn from related products.

Step 4: Tools and Resources for Protecting Your Assets

Practical, accessible resources can help you navigate ownership clearly and confidently:

  • The Authors Guild: Provides advocacy and contract review services to support your interests. With more than 16,000 members, the Authors Guild is the nation’s oldest and largest professional organization for published writers.

  • Copyright.gov: The U.S. Copyright Office promotes creativity and free expression by administering the nation’s copyright laws and by providing impartial, expert advice on copyright law and policy for the benefit of all.

  • Creative Commons: Provides CC licenses and public domain tools that give every person and organization in the world a free, simple, and standardized way to grant copyright permissions for creative and academic works; ensure proper attribution; and enable others to copy, distribute, and make use of those works.

  • Writer Beware: Offers guidance on avoiding scams and understanding publishing contracts. Sponsored by the Science Fiction and Fantasy Writers Association ( SFWA®)

Step 5: Understand the Public Domain

When copyright expires, creative works enter the public domain. Notable examples include the original Winnie-the-Pooh by A.A. Milne (the original stories, not Disney’s adaptations), Mary Shelley's Frankenstein, and many works by Shakespeare and Jane Austen. Public domain status means these works can be freely used, adapted, and distributed without permission or fees.

Step 6: Stay Vigilant and Proactive

Regularly review your agreements and clearly communicate your expectations. Ensure your credits and copyrights appear consistently across all your published works.

🔴 JUN 20 · Rattle Magazine’s “Poets Respond” challenge calls for poems inspired by “a news story or public event from the previous week, and has been written in the time since.” Selected poems will appear as the Sunday poem at Rattle.com which appear to over 10,000 people via RSS feed and daily email service. Poets will receive $100 and a free print magazine subscription. Each week's deadline is Friday midnight PST.

⭐ JUN 20–23 · MisCon 39: Hive of Scum and Villainy with Guests of Honor Jonathan Maberry (author), Casey Renee Cosplay (cosplayer), Doug Hemphill (sound engineer), Andy VanOverberghe (artist), and Patrick Swenson (publisher) at the Missoula County Fairgrounds, Missoula, MT. Full weekend registration: $75; single-day passes: $30–$40; children under 12: free with adult. This four-day celebration of fantasy, science fiction, horror, gaming, cosplay, and anime features panels, workshops, a film festival, costume contest, art show, gaming sessions, and more. The expanded venue offers 30,000 sq ft of indoor space and 18,000 sq ft of outdoor area, including programming tents, vendor spaces, and a cosplay pavilion. On-site camping is available by reservation.
